Where a Power of Attorney for Personal Care grants authority for a person you appoint to make health care decisions on your behalf, a Living Will provides binding instructions that the Attorney for Personal Care and your Treatment Providers must follow.
If you want to provide such instructions, we go over a series of very specific scenarios, and provide guidance about the way in which you would answer those questions.
Some of my clients want to give these instructions, so their feelings are clear. Other clients wish to give full freedom to the attorney for personal care to make the decisions that are appropriate in the circumstances. There really isn’t a right or wrong way to proceed. It depends upon how important it is to you that your treatment proceed in a specified matter.
